Court orders USCIS to reactivate residency applications of 83 immigrants

A federal judge ruled Monday in against the pause on residency applications permanent detention of more than eighty immigrants from countries whose citizens have restricted entry to the United States.

Judge Geroge L Russell of the state of Maryland ordered the United States Citizenship and Immigration Services (USCIS) to resume the residency cases of the 83 individuals who filed the lawsuit.

USCIS “has no discretion to decide not to adjudicate” the cases at all,” said the judge, who determined that the pause, imposed by the Donald Trump Administration, is illegal.

At the momentthe US blocks or restricts entry into the country of individuals from 39 countries and people with Palestinian Authority documents.

In today’s ruling, The judge points out that the Government has not explained why it decided to pause immigration benefits for people from these countries who have been in the country “for years, even decades, have maintained a stable status and, in many cases, have contributed substantially to medical and scientific research.”

In addition to travel restrictions, The Trump Administration also canceled the review of migrant visa applications from 75 countries around the worldincluding Afghanistan, Brazil, Colombia, Egypt, Iran, Russia and Somalia.

Human rights organizations, as well as the UN refugee agency and human rights offices, have condemned the travel bans and restrictions, arguing that migrants and foreigners have the right to due process.
