In Texas it is common to see people traveling in the open bed of a pickup truck, especially in rural areas, beaches or during local celebrations. But a common scene does not always mean that it applies the same to everyone. State law does establish clear limits, especially when there are minors.

The quick answer is this: in Texas, Adults can generally ride in the open back of a van, but those under 18 have significant legal restrictions. The main rule appears in Texas Transportation Code §545.414.

What the law allows in Texas

Under state law, a person commits a violation if he or she drives an open-bed pickup truck, open-bed truck, or tows an open trailer while a minor under 18 years of age travels in the back.

That means, in general terms:

  • People over 18 years of age: they can travel in the back under state law.
  • Children under 18 years of age: normally not.
  • The driver may receive a penalty if he fails to comply with the rule.

What are the exceptions

Texas contemplates specific situations in which a minor could travel behind as a factual defense against an infringement. Among them:

  • Participation in an authorized parade (such as the Battle of Flowers 2026).
  • Emergency.
  • Circulation on the beach.
  • When it is the only vehicle in the home.
  • Transfer of agricultural workers between fields on certain rural routes.
  • Hayrides (authorized rides) with official permission.

Some cities or counties may apply additional rules at specific events, beaches or areas. Therefore, even within Texas, it is advisable to check local regulations if it is a festival, parade or tourist area.

How much can the fine be?

The violation may be considered a minor infraction and may result in fines of between $25 and $200 dollarsaccording to the text of the standard.

But there is something else. Although it is possible for adults, there is a real problem: it does not mean that it is safe. The open bed of a pickup truck is not designed for passengers. There are no seat belts, no airbags and hard braking can throw a person.

Additionally, a minor crash can cause serious injuries. In fact, the Insurance Coverage Institute for Motorway Safety (IIHS) reminds that pickup beds are designed for cargo, not people.

Therefore, although the law allows it in certain cases, the safest option is still to travel inside the cabin with a seat belt.
