kim kardashian and her successful brand of girdles and lingerie, Skimsare in the eye of the hurricane. A small businesswoman from New York filed a Federal Trademark Infringement Lawsuitalleging that the celebrity improperly used the name of her best-selling collection: “Suits Every person”.
The lawsuit, filed in the Southern District of New York by the designer Denise Cesaremaintains that its brand, Suits Every person To AT, has operated under that name for almost a decade, long before Skims burst onto the market in 2019.
According to court documents accessed by Internet page Six, Cesare has held active federal registrations for the brand since 2016.
Cesare’s defense describes the case as an example of “reverse confusion”where a massive corporation uses its enormous marketing machine to outshine a smaller competitor. The lawsuit alleges that Skims made a “calculated decision” to continue using the name even after receiving infringement notices two years ago.
“Trademark law doesn’t care about how big you are or how many followers you have; it’s about who used the trademark first,” stated Jessica Mathews, an attorney for the plaintiff.
The indictment suggests that Skims banked on its financial ability to “crush” the small business, trusting that Cesare would not have the resources to fight back.
The conflict is not minor, given that the “Suits Every person” line is one of the pillars of Skims, currently valued at 5 billion dollars. This specific collection is estimated to have generated revenue of between $700 and $900 million.
Cesare is currently seeking a court order prohibiting Skims from continuing to use the name, as well as damages that include any profits earned by Kardashian’s brand through use of the disputed term. So far, Skims representatives have not issued official comments.
