Appeals court allows Trump to temporarily maintain 10% world tariff

A federal appeals court has supported that the President’s Administration donald trump keep applying the 10% world tax imposed by the Republican in February after the Supreme Court will invalidate a large part of its previous tariff scheme.

The court on Thursday granted a temporary victory for the Trump Government by allowing fees to continue to be collected while the good process against these liens, applied under the Section 122 of the Trade Act of 1974 and with a scheduled expiration date of the end of July, if they are not extended by Congress.

The battle over tariffs continues

In May, a panel of International Trade Court in New York failed 2-1 in favor of a lawsuit imposed by small businesses and ruled that these new tariffs were “invalids” and “not authorized by law”considering that Trump had exceeded the tariff authority delegated by Congress.

The Section 122which until now had not been invoked to justify import taxes, gives the American president the ability to impose global tariffs of up to 15% for 150 daysafter which approval from legislators is required to extend this period.

After the Supreme Court’s setback, Trump threatened in February to raise the new tax to 15% to US trading partners, although so far it has not done so.

Liens will remain in effect while the litigation progresses

He Supreme Court ruled that the president did not have the authority to apply fees under the International Economic Emergency Powers Act (IEEPA) of 1977the dismal of much of the aggressive tariff policy launched by Trump since his return to power in January 2025 for a second term.

Last April, the US Government launched the process for the reimbursement of about 166 billion dollars illegally collected through tariffs annulled by the high court.

The Supreme Court’s ruling affects the taxes that Washington calls “reciprocal”imposed by the Republican with the objective of reduce the trade deficit of the US with its partners, in addition to the additional tariffs of 25% to Mexico and Canada to pressure these countries to stop the flow of fentanyl.
