Mexican Prosecutor’s Office begins investigation against Rubén Rocha and 9 other officials after US accusation

The Current Prosecutor’s Office of the Republic (FGR) of Mexico reported that it will begin an investigation to determine if “there is evidence” that supports the accusation of the US Department of Justice towards the governor of the state of Sinaloa, Ruben Rocha Moyaas well as nine other officials for links to drug trafficking and possession of weapons.

“The Prosecutor’s Office of the Republic will begin an investigation to obtain all the information necessary to know if there is evidence that the accusation made by US authorities has the basis to simply request arrest warrants,” said Ulises Lara López, Special Prosecutor in Investigation of Relevant Matters and spokesperson for the FGR.

Also, he highlighted that as Mexican law indicates, The arrest warrant requires “presenting evidence that infer the possibility that a person has committed a crime”, so according to the Bilateral Treaty, “extradition will only be granted if it is determined that the evidence is sufficient.”

Likewise, he explained that any request for provisional arrest or extradition from the US Government to Mexico should not be disclosed or made public, as “happened in this case in narrate”, in which the Prosecutor’s Office of the Southern District of New York released the accusation against the ten officials of the state of Sinaloa.

“Releasing such information for other purposes could be detrimental to the confidential nature of criminal proceedings in the United States and contrary to the procedural rules that govern them,” he stressed.

On the other hand, he specified that the country’s own legislation indicates that – in the case of governors and senators – “it is necessary to initiate a trial of provenance to obtain a declaration that removes procedural immunity” to the designated public servants.

The message issued by the FGR occurs hours after the US Department of Justice reported a formal accusation against Rocha Moya and nine other high-level officials in Sinaloa for drug trafficking and weapons crimes, in a case that links them, in narrate, with the faction of Los Chapitos.

Those involved would have protected cartel operations, provided shimmering information and allowed the transfer of drugs to the United States, in exchange for million-dollar bribes.
