President Donald Trump formally appealed the court ruling that held him responsible for fraud in his company and asked to revoke the business limits that were imposed on him and his children in New York after losing a high-profile civil suit in that city in 2024.

Trump’s defense asked the highest court of the state of New York to annul the remainder of the civil case for fraud against himarguing that it is a “stunning and factually unfounded” process with political motivations.

In a brief of more than 100 pages presented to the New York Court of Appeals, The president’s defense asked to revoke both the determination of responsibility and the sanctions still in force against him and his family company, the Trump Organization.. According to his lawyers, the case brought by the general prosecutor Letitia James represents an “unprecedented” use of state laws.

The stunning action has its origins in a lawsuit filed in 2022, in which Prosecutors accused Trump of inflating the value of his assets for financial gain, including favorable conditions on loans and insurance.

Split ruling maintains liability, but reduces penalties

The case resulted in a first instance ruling led by Judge Arthur Engoron, who found that Trump and his associates engaged in fraud over several years. As part of the sentence, a fine exceeding $450 million was imposed, a figure that with interest reached more than $500 million.

However, a mid-level appeals court later overturned the financial penalty as excessive.although it kept intact the conclusion of liability and other restrictive measures.

These included the temporary disqualification of Trump and his eldest sons, Donald Trump Jr. and Eric Trump, from holding management positions in companies. within New York, as well as limitations to access financing in financial institutions in the state.

Although the ruling significantly reduced the economic impact, the president’s defense maintains that the permanence of these restrictions is unfounded and could affect both his business operations and the business environment in New York.

Defense insists on political motivations and questions evidence

In their appeal, Trump’s lawyers argue that prosecutor James improperly used a law designed to combat “persistent fraud.” and they maintain that its application in this case constitutes a selective action for political purposes.

They also question the weight of some testimony presented during the trial, including that of Trump’s former non-public lawyer, Michael Cohen, who was a key figure for the prosecution. The defense claims that recent statements by Cohen suggest that he was pressured to offer testimony to support the case..

Likewise, they emphasize that none of the financial institutions involved presented formal complaints for having been harmed, which, in their opinion, weakens the central arguments of the accusation.

For its part, the general prosecutor’s office has not issued recent comments on this new appeal.although he is expected to present his formal response to the court in the coming weeks.

The case is part of a series of legal challenges that have surrounded Trump in recent years, both civil and criminal, and that continue to have political and economic repercussions.

As the process moves forward in the courts, the final resolution could have relevant implications not only for the president’s business future, but also for the scope of the legal powers of state prosecutors in cases of corporate fraud.
