An Egyptian family consisting of a mother and her five children was detained again by federal immigration authorities just days after a judge ordered his release, in a case that has intensified the debate about compliance with court orders and immigration policies in the United States.

Legal dispute for alleged contempt of court order

The family’s attorneys maintain that the new detention directly violates the order issued by federal judge Fred Biery, who had directed that El-Gamal and his children not be detained or deported. In response, the court issued an additional emergency order to prevent his transfer while the case is reviewed.

“The attempt to deport the family constitutes a clear violation of a federal court order and must be stopped immediately,” the legal team said. in a statement. They also reported that appeals have been filed in multiple instances, including the Fifth Circuit and a federal court in Colorado.

For its part, The Department of Homeland Security (DHS) defended the actions of the immigration authorities, ensuring that the family has received “complete due process.” In a statement, DHS officials criticized the court decision that ordered his release, calling it inappropriate and reiterating their intention to continue with the deportation process.

Context of the case and criticism of immigration policy

The El-Gamal family was initially detained in June of last year, after the woman’s ex-husband was accused of a firebombing attack on a protest in Boulder, Colorado. Despite this, the authorities have not filed charges against the mother or the minors, and an FBI agent stated that there was no evidence that they had knowledge of the attack.

After the incident, the family requested asylum in the United States, citing fear of returning to Egypt. During his detention, his lawyers alleged deterioration in El-Gamal’s health, including hospitalization for an untreated medical condition.

The case has generated criticism from legislators and immigrant rights organizations, who question the prolonged detention of minors. and the apparent attempt to punish the family for a crime committed by a third party.

Democratic Senator Dick Durbin pointed out that the insistence on keeping the family detained, despite the court order, reflects discriminatory motivations. “It is not because they represent a danger, but because of their status as immigrants,” he said.

In the midst of a stricter immigration policy promoted by the current administration, this case could set a precedent on the limits of executive power in the face of judicial decisions on immigration matters. Meanwhile, the future of the El-Gamal family remains uncertain, pending new rulings in the federal courts.
